Cosmic Clutter may modify this Agreement at any time, and such modifications shall be effective immediately upon posting of the modifications and your continued access or use of the services shall be deemed your conclusive acceptance of the modified Agreement.

YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18 years of age, you may use CosmicClutter.com only with involvement of a parent or guardian. Cosmic Clutter reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

Cancellations-Once a customer has placed an order and submitted payment, the order cannot be canceled by the customer. Cosmic Clutter may at its discretion cancel an order at the customer's request, before shipment is made. Shipping fees are not refundable if an order is canceled after it has been shipped.

Indemnification-You agree to defend, indemnify and hold completely harmless Cosmic Clutter from and against any and all claims, damages, costs and expenses, including attorney's fees, arising from or related to your use of the products purchased via the site.

PRODUCT DESCRIPTIONS
Cosmic Clutter attempts to be accurate as possible. However, Cosmic Clutter does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Cosmic Clutter itself is not described, your sole remedy is to return it in unused condition. Cosmic Clutter is not responsible if a publisher or manufacturer changes the appearance of a product after it has been solicited. This includes but not limited to comic book, trade paperback, hardcover, toy and collectible images, content or change in creators. Some products may differ from the photos provided.

Allocations-Cosmic Clutter may from time to time choose to allocate items and/or quantities of items order by customers.

RETURNS, REFUNDS, EXCHANGES AND DAMAGED ITEMS
Comic books are shipped in new unread condition. All comic books are shipped two to a bag and board (flip side) and shrink wrapped together and to a slightly larger backer board. When Cosmic Clutter receives a shipment of comic books from our distributor, they are in NEW condition. This does not guarantee that they are in Mint or Near Mint condition. Therefore, Cosmic Clutter can not guarantee that all comics will be in Mint or Near Mint condition when shipped. If you wish to have ONLY MINT CONDITION items shipped to you this must be specified when your order is placed. Please note this in the customer comment box EVERY time you place an order with Cosmic Clutter, your request WILL be honored. If no mint condition items can be found, that item will be removed from you order, you will not be charged for what you do not receive. Comic Books are collectible items and are only returnable if damaged during shipping and WILL NOT BE ACCEPTED IF THEY HAVE BEEN REMOVED FROM THE SHRINK WRAP. If comic books are damaged during shipping please contact customer service for return instructions. Please remember, damaged comics CANNOT BE RETURNED IF REMOVED FROM SHRINK WRAP. Other items such as statues, busts, toys are not considered as damaged if they only have a scratch or minor ding (1/2" or less). Damaged is considered to be a major flaw, such as a broken arm, leg, etc. A Damaged box is not considered a damaged item. If you receive a damaged item please contact customer service for replacement or refund. You have 30 days from purchase date to report Damages.

Chargebacks-If a customer initiates a chargeback, we will charge you a $35 fee and turn the account over to our collection agency in addition to the purchase price, on every chargeback order, if we believe you have purchased the product and did a chargeback in bad faith.

YOU EXPESSSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. COSMIC CLUTTER DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM COSMICCLUTTER.COM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. COSMIC CLUTTER WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. Follow all instructions and heed all warnings accompanying any product ordered from the site. Some products, including those with small pieces, may not be suitable for children and should be kept out of reach of children.
